Los matrimonios “civiles” son aquellos en los que los propios contrayentes registran el matrimonio ante el gobierno dominicano. La persona que oficia la ceremonia matrimonial es un funcionario del gobierno, normalmente un notario público. Es decisión de la pareja celebrar o no una ceremonia religiosa por separado.

Los matrimonios “canónicos” son los celebrados por un sacerdote católico romano. Tras la ceremonia, la iglesia se encarga de registrar el matrimonio en las oficinas gubernamentales dominicanas correspondientes.

El matrimonio en la República Dominicana es un contrato civil entre un hombre y una mujer que han acordado libremente casarse y tienen capacidad para hacerlo. Para casarse en la República Dominicana, un hombre y una mujer deben cumplir las siguientes condiciones:

El funcionario del gobierno que realiza la ceremonia civil tiene la autoridad, en el momento de la ceremonia, para renunciar a cualquiera de los requisitos anteriores. Dicha exención debe hacerse por escrito y exponer los fundamentos de la misma.

El funcionario que celebra la ceremonia lo hace en presencia de las partes y los testigos. Durante la ceremonia, el funcionario pregunta a las partes y a los testigos si alguna de ellas ha estado casada anteriormente, entre sí o con otras personas. La parte que ha estado casada anteriormente debe proporcionar la fecha de ese matrimonio y el nombre de la persona que lo ofició.

The Official of the Civil Status, at the moment of the celebration of the marriage, can dispense to the contracting parties of any of these requirements for reasonable reasons.    Said dispensation must be made in writing explaining the reasons and must be stated in the marriage certificate and marriage certificate.
